Morgan Hill has become the center of a national controversy this week after four Live Oak High School students were sent home for wearing American flag shirts on Cinco de Mayo. Assistant Principal Miguel Rodriguez sent Daniel Galli, Austin Carvalho, Matt Dariano and Dominic Maciel home from school yesterday after they refused to turn their shirts inside out. The administrations reasoned that by donning the patriotic t-shirts, the teenagers were offending Live Oak’s Mexican-American student’s right to show pride on the May 5 holiday. "They said we could wear it on any other day," Daniel Galli told San Jose's KNTV. "But today is sensitive to Mexican-Americans because it's supposed to be their holiday, so we were not allowed to wear it today." After the students and their parents protested Rodriguez’s decision in the Morgan Hill Times, the story was picked up by the Associated Press and has since gone viral. Today the story was featured on the front of Yahoo News, and the controversy is getting significant coverage on Fox News and CNN.

Anthony William Librers of Morgan Hill, a tow truck driver, was shot early Saturday morning and was on life support on Saturday, according to a family member. Known as Tony, he is the son of Joseph Librers and Elizabeth Westphal and the brother of Joseph A. Librers. “We are devastated by this,” said Morgan Hill councilmember Marilyn Librers, who was Tony’s stepmother when he was young. She said he passed away Sunday morning. Librers suffered a gun wound in the Central Valley early Saturday morning, according to stepbrother Tim Hennessey. Librers, who was 31 years old, has worked for Ponzini's Towing in Morgan Hill for about a decade and wanted to become a California Highway Patrol officer. “He was always trying ot help other people. He was fearless,” Hennessey said. “He didn’t have a mean bone in his body.” Librers has three girls, the oldest of whom is 12. “He just enjoyed doing his thing: driving a tow truck, playing with his kids and trying to become a law enforcement officer,” Hennessey said. A spokesman for the Modesto Police Department, even after checking with county law enforcement officials, had no information about the shooting, which reportedly occurred near the city limits. Updated October 18, 11:32pm. ADDENDUM October 20, 2009 The Gilroy Dispatch reported on Tuesday that Librers’ death occured as a result of his “accidentally shooting himself with a handgun during a camping trip.” The newspaper quoted the victim’s father, Joseph Librers, as saying the shooting occured in Tuolumne County, east of Stockton. "They were having a party around a campfire. Tony had a handgun and it went off accidentally. He had the clip out of it but he didn't clear the chamber," Librers told the Dispatch.

By Erin Sherbert OFFICER Geoff Guerin slams the accelerator of his white unmarked car and guns it down a narrow alley near Louis Street. A group of men huddled in the center of the alley take off running, tossing beer cans, baseball caps and cigarettes as they sprint and hop over fences. Guerin jumps out of the car with his hand on his holster. He yells as he runs: "Garcia! Garcia!" He is after a portly man wearing a large black T-shirt and nylon shorts hanging over his knees. The man runs toward a dilapidated two-story apartment complex tucked at the end of the alleyway. Apparently realizing there's nowhere to go, he slows down, walking back toward Guerin with his hands over his head. Guerin and his partner, Officer Doug Remmick, snap handcuffs on his wrists. The man, 20-year-old Andrew Garcia, is a well-known parolee—according to Guerin, one of Gilroy's most hardened criminals, born into the Norteño street gang.

A WOMAN in a white T-shirt gently rocks a tiny, peach-fuzz-haired baby swaddled in a light pink blanket. The infant and its caretaker sit among some 40-odd spectators packed into Courtroom 109 at South County Court House on June 30. The newborn stays remarkably quiet, barely stirring though the half-hour court proceeding. They are all there to observe the second hearing of the most controversial murder case to come out of Gilroy in years. The child's mother, 18-year-old Heather Marie Ashford, sits across the room in baggy orange prison garb, a heavy-duty chain around her waist and her hands in cuffs. Her hair in a bun and her eyes red, Ashford wipes away tears when Judge Theresa Guerrero-Daley calls her name to stand.

District Attorney Dolores Carr today announced an unprecedented move in prosecuting gang violence in Santa Clara County, charging five people involved in the shooting of 18-year-old Larry Martinez with murder. “We are sending the message today, by prosecuting this case, that our community and our law enforcement agencies do not and will not tolerate gang violence,” Carr said at a press conference in front of the new South County Courthouse in Morgan Hill. “The people of Santa Clara County deserve protection from these menaces. People need to understand that if they choose to become involved in gang violence … they can be expected to be prosecuted by our office.” Carr will be using a rarely-invoked “provocative act” clause in California law to prosecute both the assailants who shot Martinez, as well the three friends who were with him when he was gunned down.
